Iowa workers’ compensation law can be a dense thicket of legal terms and conditions that is hard for the layperson to decipher. It’s why at The Law Offices of James P. Hoffman, we’ve decided to present the answers to some common questions we receive from clients. 


What injuries does Iowa workers’ compensation law cover?

In this instance, injury is defined as a health impairment resulting from work. It must not be due to the normal wear and tear of day-to-day living. Diseases and hearing loss from employment are also considered injuries.


Who is eligible for compensation?

Employees hurt in Iowa, those under a contract made in Iowa, or whose work is mainly in the state are eligible for benefits from a job-related injury.


Who pays the benefits for a claim?

Employers that purchase private insurance to provide coverage pay the premiums. The insurance company then pays the workers’ compensation benefits to the injured employee.


What benefits are provided?

There are both medical and disability benefits paid under the law. Medical benefits cover reasonable and necessary care for the injury. Disability benefits are not to exceed 80% of an employee’s “spendable earnings,” which is the amount a worker has left over after payroll taxes are deducted from wages.
